Assuming that Al Franken is really seated (likely) and the appointee from Illinois is a Dem (likely), that will be 59 votes (almost filibuster-proof).
So, what would have to happen would be a GOP senator changing stripes (unlikely) or one of them leaving office in a state with a Dem governor.
