I noted in looking into the RNC 8 that the charges against David McKay were as such:
McKay was named last September in a three-count federal indictment alleging that he built and possessed Molotov cocktails, and that the devices lacked serial numbers.
Now, that statement itself made me wonder, "If he'd merely numbered them, would that have been OK?"
But it turns out it's a little more complex. If (IF) your state permits ownership of personal molotov cocktails, then you can fill out this handy form to get your serial numbers for them:
Now, given that the inspiration to make the explosives *came from* the FBI's paid snitch, the idea that the feds might waste countless dollars re-re-retrying a case that's already failed once is expectable, since entrapment is a valid enough defense in this case.
One has to take into account that this snitch was *famous* for his organization and humanitarian activities (such that they would want to emulate him), and his suggestion for their use involved no injury to humans (he wanted them used on parked cop cars).
And, of course, one has to take into account the inciting that the police did by arresting them all and confiscating property in the first place (which the snitch likely set up, if you think of it).
All it takes is one in a dozen to have half a brain and that trial will go on longer than OJ's do.

Brandon Darby testified in the case of David McKay the last week of January 2009. After 3 days of deliberation, the trial ended in a hung jury, largely due to the role of Brandon Darby as a provocateur. McKay will be retried in March.
